Private or independent schools are not required to comply with the equality duties, although they are strongly encouraged to do so as it will help them to establish and maintain good practice in promoting equality. It is unlawful for private and independent schools to discriminate on grounds of race, sex, disability or sexual orientation in admissions, access to benefits or services, exclusions, and in the employment of staff. There are some limited exceptions related to religion and belief.
